The nature of ownership right in Islamic jurisprudence and Iran law

چکیده :

If we view ownership right in the void, it is clear that ownership right have not any conflict with other rights. However, since human live in the society, particularly in nowadays society with extreme complexity and intertwined social relationships. Hence, ownership rights in its principle interpretation could interfere with other rights. Therefore, mere ownership of an object haven’t cause any conflict with other peoples in the community, but when considering this right to ownership of person to a property, the interference is begins too. My ownership right will conflicts with other people rights to ownership, and my ownership right will conflicts other rights of people such as right to welfare and easement; therefore, the discussion begins here, what is the human role in this matter in order to resolve this conflict while solve and manage this type of conflicts according to time and places condition. In this manuscript we concluded that ownership have been limited by the government through using jurisprudence and juridical instruments, therefore, government managed these conflicts while solving it.
