Ehsan Rule and Its Role in the Exemption of Compensation

چکیده :

Ehsan Rule is one of inalienable and effective rules in Islam law with a wide range that has been concerned by jurists and lawyers. This rule is noted as responsibility resolve and liability. According to this rule, If the philanthropist person intends to deliver profits or avoid losses of another in accordance with the provisions such goodwill and avoiding a worse loss, the action is not binding. Because if with philanthropist be behaved like deleterious mankind abstain of Ehsan. The value of philanthropist act and obscenity punish of philanthropists to the extent that is God in numerous verses of the Holy Quran has put his friendship and love about philanthropists. The objective of this study is to use rational and traditional documents of Ehsan Rule and citing the jurisprudential, legal and academic resources and also different studies based on Quran and Hadith to highlight Ehsan Rule as one of cases to exempt compensation and overthrow compulsory liability and referring to civil and criminal laws related with this Rule is shown that can play an important role in relations between citizens and legal system of Iran
